The regulatory agencies are scrutinizing the impact of bank’s mortgage servicing processes on consumers, especially for borrowers provided payment accommodations in the last two years. Recent supervisory publications warn banks and other mortgage servicers of practices noted during recent exams that violate Regulation Z and X’s mortgage servicing rules and worse yet, have been deemed unfair, deceptive and even abusive. As a result, banks – large and small – need to ensure their servicing practices are fully compliant and transparent.
